These Terms and Conditions (“Terms”) govern your access to and use of the Augustus Courses (“AUGGS Courses,” “we,” “us,” or “our”) website, online courses, and all other services we provide (collectively, the “Services”).

Please read these Terms carefully before using our Services. By creating an account, or by accessing or using our Services in any manner, you agree to be bound by these Terms. If you do not agree to all of the Terms, you may not access or use the Services.

1. Your Account with AUGGS Courses

  • Eligibility: To use our Services, you must be at least 13 years old. If you are under the age of 18, you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
  • Account Creation: You must provide accurate, current, and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your account and password.
  • Account Responsibility: You are responsible for all activities that occur under your account, whether or not you have authorized them. You agree to notify us immediately of any unauthorized use of your account by contacting us at [email protected].

2. Code of Conduct

AUGGS Courses is a global platform dedicated to learning and professional development. We expect all users to contribute to a respectful and safe environment. By using our Services, you agree not to:

  • Use the Services for any illegal or unauthorized purpose.
  • Post or transmit any content that is unlawful, fraudulent, defamatory, obscene, or otherwise objectionable.
  • Share content that infringes upon the intellectual property rights, privacy rights, or other rights of third parties.
  • Engage in any form of academic dishonesty, including cheating on assignments or exams, or helping others to do so.
  • Distribute spam, unsolicited or bulk electronic communications, chain letters, or pyramid schemes.
  • Knowingly introduce viruses, trojans, worms, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, the server on which the Services are stored, or any server, computer, or database connected to the Services.

We reserve the right to suspend or terminate your account for violations of this Code of Conduct.

3. Content and Intellectual Property

  • Our Content: The Services and all materials therein, including, but not limited to, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, and music (the “AUGGS Content”), are and will remain the exclusive property of AUGGS Courses and its licensors. Our Services are protected by copyright, trademark, and other laws of both the European Union and foreign countries.
  • Your License: We grant you a limited, non-exclusive, non-transferable license to access and view the courses and associated content for which you have paid all required fees, solely for your personal, non-commercial, educational purposes through the Services, in accordance with these Terms.
  • User Content: If you post content, such as comments, questions, or assignment submissions (“User Content”), you grant AUGGS Courses a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content in any and all media or distribution methods. You represent and warrant that you have all the rights, power, and authority necessary to authorize us to use any User Content that you submit.

4. Payments and Refunds

  • Fees: Certain Services, such as premium courses and certificate programs, require payment. You agree to pay the fees for the Services that you purchase, and you authorize us to charge your debit or credit card or process other means of payment for those fees.
  • Pricing: We reserve the right to change our prices at any time. Any price changes will be announced on our website or through email.
  • Refund Policy: Our refund policy is detailed on our website. Please review it carefully before making a purchase. Unless otherwise specified, requests for refunds must be made within 14 days of purchase. No refund will be issued for courses that have been substantially completed or for which a certificate has been issued.

5. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AUGGS COURSES AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AUGGS COURSES, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR USE OF THE SERVICES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS AND DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES, REGARDLESS OF THE FORM OF ACTION, IS LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT OF FEES, IF ANY, THAT YOU PAID TO US FOR THE USE OF THE SERVICES IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, OR (B) €100.

7. Indemnification

You agree to defend, indemnify, and hold harmless AUGGS Courses and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Any dispute arising from these Terms shall be resolved through final and binding arbitration, rather than in court. The arbitration will be conducted in Nairobi, Kenya, by a single arbitrator in accordance with the rules of the Nairobi Centre for International Arbitration (NCIA).

9. General Terms

  • Changes to Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
  • Entire Agreement: These Terms constitute the entire agreement between you and AUGGS Courses and supersede and replace any prior agreements we might have had between us regarding the Services.
